{"id":1207556,"date":"2023-11-30T13:50:51","date_gmt":"2023-11-30T18:50:51","guid":{"rendered":"https:\/\/www.prime-wow.com\/?p=1207556"},"modified":"2023-11-30T13:50:51","modified_gmt":"2023-11-30T18:50:51","slug":"meta-sues-ftc-to-block-new-restrictions-on-monetizing-kids-data","status":"publish","type":"post","link":"https:\/\/www.prime-wow.com\/?p=1207556","title":{"rendered":"Meta sues FTC to block new restrictions on monetizing kids\u2019 data"},"content":{"rendered":"<p>Meta has sued the Federal Trade Commission (FTC) <a data-i13n=\"cpos:1;pos:1\" href=\"https:\/\/www.pacermonitor.com\/view\/JGNKVTA\/META_PLATFORMS_INC_v_FEDERAL_TRADE_COMMISSION_et_al__dcdce-23-03562__0001.0.pdf?mcid=tGE3TEOA\"><ins>in an attempt to stop regulators<\/ins><\/a> from reopening a landmark $5 billion privacy settlement from 2020 and to allow it to monetize kids\u2019 data across apps like Facebook, Instagram and Whatsapp. This comes after a federal judge ruled on Monday that the FTC would be allowed to expand on 2020\u2019s privacy settlement, paving the way for the agency to propose tough new rules on how the social media giant could operate in the <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/www.engadget.com\/mark-zuckerberg-misled-congress-sec-docs-183809371.html\"><ins>wake of the Cambridge Analytica scandal.<\/ins><\/a><\/p>\n<p>Today\u2019s lawsuit demands an immediate stop to the FTC\u2019s proceedings, calling it an \u201cobvious power grab\u201d and an \u201cunconstitutional adjudication by fiat.\u201d A Meta spokesperson even referred to the FTC as \u201cprosecutor, judge, and jury in the same case\u201d, <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/www.bnnbloomberg.ca\/meta-sues-to-halt-ftc-privacy-move-challenging-in-house-trials-1.2005472\"><ins>as reported by <\/ins><em><ins>Bloomberg<\/ins><\/em><ins>.<\/ins><\/a> This is the second attempt by Facebook\u2019s parent company to stop the sanctions in court.<\/p>\n<p><span id=\"end-legacy-contents\" \/><\/p>\n<p>The FTC, for its part, says that Meta has repeatedly violated the terms of 2020\u2019s settlement regarding user privacy. The agency also says that the company has violated the Children\u2019s Online Privacy Protection Act (COPPA) by monetizing the data of younger users. The FTC has already been given the go ahead by a judge to restrict this type of monetization, a decision Meta hopes to overturn.<\/p>\n<p>The FTC also seeks to implement new restrictions that limit Meta\u2019s use of facial recognition, as well as a complete moratorium on new products and services until a third-party completes an audit to determine if the company\u2019s complying with its privacy obligations.<\/p>\n<p>\u201cFacebook has repeatedly violated its privacy promises,\u201d Samuel Levine, director of the FTC\u2019s Bureau of Consumer Protection, <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/www.engadget.com\/the-ftc-wants-to-ban-meta-from-profiting-from-kids-data-180720686.html\"><ins>said in a statement.<\/ins><\/a> \u201cThe company\u2019s recklessness has put young users at risk, and Facebook needs to answer for its failures.\u201d To that end, multiple states have sued Meta to stop the monetization of children\u2019s data, along with the EU.<\/p>\n<p>The FTC has been a consistent thorn in Meta\u2019s side, as the agency tried to stop the company\u2019s acquisition of VR software developer Within on the grounds that the deal would deter &#8220;future innovation and competitive rivalry.&#8221; The agency <a data-i13n=\"cpos:5;pos:1\" href=\"https:\/\/www.engadget.com\/ftc-drops-bid-to-block-metas-acquisition-of-within-153748315.html\"><ins>dropped this bid<\/ins><\/a> after a <a data-i13n=\"cpos:6;pos:1\" href=\"https:\/\/www.engadget.com\/ftc-reportedly-loses-court-order-to-block-metas-acquisition-of-vr-developer-within-172220645.html\"><ins>series of legal setbacks. <\/ins><\/a>It also opened up an investigation into the company\u2019s VR arm, accusing Meta of <a data-i13n=\"cpos:7;pos:1\" href=\"https:\/\/www.engadget.com\/ftc-meta-investigation-antitrust-virtual-reality-211947952.html\"><ins>anti-competitive behavior.<\/ins><\/a><\/p>\n<p>Corporations have been all over the FTC lately in attempts to paint the agency as a prime example of government overreach.
